Title 25 › CHAPTER 24 — INDIAN LAND CONSOLIDATION › § 2220
Owners who together hold all the undivided trust or restricted interests in a piece of land can apply to the Secretary to run the surface of that land themselves and, once approved, lease it for farming without more Secretary approval for up to 10 years. The Secretary must approve an eligible owner’s application unless there is reason to think it was made because of fraud or undue influence, and applications cannot be filed until 1 year after a notice is published under section 8(a)(4) of the American Indian Probate Reform Act of 2004. A lease is not valid unless every owner has signed it. Mineral leases and other transactions that federal law requires the Secretary to approve are not changed by this rule. While an interest is in owner-managed status, the Secretary does not collect or account for lease money. Tribal jurisdiction over the land stays the same, and people using the land are treated as agreeing to the tribe’s laws. Owner-managed status stays with the interest through transfers or inheritance until all owners jointly ask the Secretary in writing to revoke it; revocation does not undo leases made before the revocation’s effective date.
