Protect Native American cultural heritage and carry out the U.S. duty to Indian Tribes. Raise the top criminal penalty for breaking the Native American Graves Protection and Repatriation Act (NAGPRA) to discourage crimes. Ban the export of cultural and archaeological items covered by NAGPRA and the Archaeological Resources Protection Act (ARPA). Create a required export certification system and let the President ask other countries to help prevent permanent harm to Native heritage. Set up a federal effort to encourage people and groups to return cultural items voluntarily. Create an interagency team and a Native working group to coordinate this work. Keep certain tribal submissions and records of denied export certifications private under the Freedom of Information Act. Encourage buyers to buy lawful contemporary art made by Native artists.
