Title 25 › Chapter 41— INDIAN LANDS OPEN DUMP CLEANUP › § 3908

Last updated Apr 5, 2026|Official source

Summary

Keeps the Director’s existing powers under section 1632 of this title and section 2004a of title 42 unchanged. It also says the chapter does not apply to three kinds of open dump sites on Indian lands or Alaska Native lands: small family-used sites of one-half acre or less on land they own or hold beneficial title; any site run for profit; and privately owned facilities that routinely accept industrial-process waste while following federal law. It also does not change or override the EPA Administrator’s duties under the Solid Waste Disposal Act (42 U.S.C. 6901 et seq.), and it does not amend, repeal, or supersede that Act.
