An entity picked by an Indian tribe to serve as its housing entity must follow the non‑Federal audit rules in chapter 75 of title 31. The Secretary may also do extra audits or reviews to check that the recipient has done eligible activities on time, followed the law and its certifications, kept the ability to keep doing those activities, followed its Indian housing plan, and that performance reports sent under section 4164 are accurate. When possible, these reviews should include on‑site visits by HUD officials. If the Secretary makes a report about a recipient, the recipient gets at least 30 days to review and comment. The Secretary may change the report after those comments and must make the report and the comments public no later than 30 days after receiving the comments. Subject to section 4161(a), the Secretary may adjust a recipient’s grant based on the report and audit findings.
