Summary

A participating Indian Tribe does not have to follow the Department’s circulars, policies, manuals, guidance, or rules unless the Tribe agreed to them in a compact or funding agreement. The Tribe still must follow the eligibility rules in section 5324(g) and any regulations made under section 5373.

Unless expressly agreed to by a participating Indian Tribe in a compact or funding agreement, the participating Indian Tribe shall not be subject to any agency circular, policy, manual, guidance, or rule adopted by the Department, except for— (1)
(2)regulations promulgated pursuant to section 5373 of this title.
