Title 25 › CHAPTER 46 — INDIAN SELF-DETERMINATION AND EDUCATION ASSISTANCE › SUBCHAPTER V — TRIBAL SELF-GOVERNANCE—INDIAN HEALTH SERVICE › § 5389
Indian tribes in tribal self-governance can carry out construction projects if they agree to take on the Federal environmental duties that would apply if the Secretary did the work. To do that, a tribe must pass a resolution that names a certifying officer to act as the responsible Federal official and accepts Federal court jurisdiction to enforce those duties. Project plans must be negotiated under section 5324(m) and added to funding agreements. The tribe and the Secretary must pick building codes and engineering standards that match national norms. The tribe must finish the project as agreed. Money for projects will come through the funding agreement as annual advance payments, with semiannual payments if the tribe wants. Payment amounts are set from agreed project schedules, past work, and prior payments. The Secretary will include contingency funds with each advance, and the tribe manages those funds. The Secretary gets at least one chance to approve planning and design before construction or when the scope changes significantly. The tribe must give progress and financial reports at least every six months. The Secretary may visit the site at least every six months or on another agreed schedule. Contractors and subcontractors (not tribes or tribal organizations) must be paid prevailing local wages as set by the Secretary of Labor under sections 3141–3144, 3146, and 3147 of title 40; the Secretary of Labor has the authorities in Reorganization Plan No. 14 of 1950 and section 3145 of title 40. Unless the tribe agrees otherwise, most federal procurement rules in division B of subtitle I of title 41 (except sections 1123, 2303, 2304, and 2313), the Federal Acquisition Regulations, and other procurement laws do not apply.
