After a tribe gets a notice from the Secretary under section 5612(b)(2), the tribe must send the Secretary a proposed Indian trust asset management plan. The plan must say which trust assets it covers; set goals and priorities for managing assets on the reservation or under the tribe’s jurisdiction; show how available money will be used to meet those goals; if the tribe already runs trust functions under contracts or compacts under the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450 et seq.), say which functions and describe the practices the tribe will use (this can include surface leasing or forest land management allowed under section 5614(b)); include a way to try nonbinding mediation for disputes with the United States; set up evaluations that the tribe and affected federal agencies can use to check management; and identify any federal rules the plan would replace. If the tribe asks in writing, the Secretary must give technical and budget help to prepare the plan. The Secretary must approve or disapprove the plan within 120 days. The Secretary must approve unless the plan misses required items, conflicts with the rule that plans must follow applicable treaties, statutes, and Executive orders (and section 5614), or costs more than the funding available for those trust assets. If disapproved, the Secretary must send a written reason. The tribe may send an amended plan within 90 days. If the Secretary does not act in 120 days, the plan is treated as approved. A tribe can seek judicial review under the Administrative Procedure Act if the plan is disapproved and the tribe has used all other administrative remedies. A tribe may end an approved plan by giving the Secretary a notice and a tribal resolution; the termination takes effect on October 1 of the first fiscal year after the notice.
