Title 26 › Subtitle E — Alcohol, Tobacco, and Certain Other Excise Taxes › CHAPTER 51 — DISTILLED SPIRITS, WINES, AND BEER › Subchapter A — Gallonage and Occupational Taxes › PART I — GALLONAGE TAXES › Subpart A — Distilled Spirits › § 5007
Taxes on distilled spirits taken out of bonded storage or out of customs custody under section 5232 must be paid under section 5061. For imported distilled spirits, the tax in section 5001(a)(1) and (2) must be collected by the Secretary and deposited as internal revenue; the Secretary makes the rules for that, and section 5688 covers how imported spirits are handled. The Secretary has authority to decide and assess these taxes and penalties (see section 6201(a)). Authority to assess tax on spirits that are not bonded is in section 5006(c). Rules about paying tax in certain cases—like spirits withdrawn free of tax, denatured spirits, and volatile fruit-flavor concentrates—are in section 5001(a)(4), (5), and (6).
