Title 26 › Subtitle E — Alcohol, Tobacco, and Certain Other Excise Taxes › CHAPTER 51 — DISTILLED SPIRITS, WINES, AND BEER › Subchapter B — Qualification Requirements for Distilled Spirits Plants › § 5181
A person can apply, with any bond and paperwork the Secretary requires, to set up a plant that makes, processes, stores, uses, or distributes distilled spirits only for fuel. The Secretary must make rules that speed up applications, set at least a minimum bond, and generally encourage making alcohol for fuel. The Secretary may also waive other rules in the chapter for such plants, except any rule that requires paying tax. Smaller plants that make only fuel alcohol and no more than 10,000 proof gallons a year get simpler treatment. The Secretary must simplify the permit form, send a written receipt within 15 days saying if the application meets the rules, and decide within 45 days after that notice. If no decision is given in time, the application is treated as approved. No bond is required for these eligible plants, and their premises are treated as bonded. Spirits made under these rules may be withdrawn free of tax as provided in section 5214(a)(12). The spirits may only be used for fuel, and before leaving the premises they must be made unfit to drink in a way that does not harm their use as fuel. Spirits made from petroleum, natural gas, or coal are not included.
