Gives plain meanings for key words used in this chapter. Counsel for the United States means U.S. attorneys, assistant U.S. attorneys, DOJ or federal agency lawyers who can sue, and private lawyers hired under section 3718 of title 31 to collect debts. Court means any court created by Congress, except the United States Tax Court. Debt means money owed to the United States from loans (direct or guaranteed) or from many other sources such as fees, rents, sale of property, overpayments, fines, taxes, restitution, damages, interest, bail forfeiture, reimbursements, or similar costs, but not debts that come from contracts originally made only between private parties. Debtor means someone who owes a debt or is claimed to owe one. Disposable earnings means pay left after legally required deductions. Earnings means pay for personal work, including wages, salary, commission, bonus, and regular pension or retirement payments. Garnishee means a person (not the debtor) who holds property or money of the debtor and is subject to garnishment under section 3104 or 3205. Judgment means a court order for the United States in a civil or criminal case about a debt. Nonexempt disposable earnings means 25 percent of disposable earnings, subject to section 303 of the Consumer Credit Protection Act. Person includes people and many kinds of organizations, such as corporations, partnerships, trusts, estates, governments, and Indian tribes. Prejudgment remedy means court actions before a final judgment, like attachment, receivership, garnishment, or sequestration. Property means any present or future interest in real or personal property, tangible or intangible, including community property and trusts, but not property the United States holds in trust for Indian tribes or individual Indians or Indian lands the United States has restricted from sale. Security agreement means an agreement that creates a lien. State means any State, the District of Columbia, Puerto Rico, the Northern Mariana Islands, or any U.S. territory or possession. United States means federal corporations, agencies, departments, commissions, boards, other federal entities, or instrumentalities. United States marshal means a U.S. marshal, deputy marshal, or a U.S. Marshals Service official designated under section 564.
