Title 28 › Part I— ORGANIZATION OF COURTS › Chapter 16— COMPLAINTS AGAINST JUDGES AND JUDICIAL DISCIPLINE › § 360
Investigation files must stay private unless section 355 says otherwise. The circuit’s judicial council may choose to give a special committee’s report under section 353(c) to the person who complained and to the judge named. The council, the Judicial Conference, or the Senate or House by resolution may release materials needed for an impeachment under Article I. A judge can allow disclosure in writing, but it also must be signed by the circuit’s chief judge, the Chief Justice, or the chair of the standing committee under section 331. Any written order to carry out an action under section 354(a)(1)(C), issued by a judicial council, the Judicial Conference, or the standing committee under section 331, must be made public through the court of appeals clerk for the circuit. Unless it would harm justice, the order should include written reasons.
