The rule does not apply to some state-run or long-standing gambling operations. It excludes state lotteries and similar games that were run by a state or local government at any time from January 1, 1976, through August 31, 1990. It also excludes games in a state that were allowed by law on October 2, 1991, if a similar non-parimutuel game actually ran there between September 1, 1989, and October 2, 1991. It excludes non-lottery casino gambling in a city if it was authorized within one year after this chapter took effect and a regulated commercial casino system operated there for the full 10-year period ending on that effective date. It also excludes parimutuel animal racing and jai-alai. Except for those exceptions, the rule applies on the Indian lands listed in section 4(4) of the Indian Gaming Regulatory Act (25 U.S.C. 2703(4)).
