Title 29 › Chapter 18— EMPLOYEE RETIREMENT INCOME SECURITY PROGRAM › Subchapter III— PLAN TERMINATION INSURANCE › Subtitle Subtitle C— Terminations › § 1348
Tells how to pick the termination date for pension plans. For single-employer plans: a standard termination uses the date named in the notice under section 1341(a)(2); a distress termination uses the date the plan administrator sets if the corporation agrees; a section 1342 termination uses the corporation’s date if the plan administrator agrees; if no agreement under 1341(c) or 1342, the court sets the date. For multiemployer plans: use the date under section 1341a(b) when that applies; for section 1342 endings, the administrator and corporation (or trustee) agree on the date or the court decides if they cannot.
