If someone breaks the rules in this chapter, they can be fined up to $1,000 for each violation. When deciding the fine, the Secretary must look at the person’s past record of following these rules (and similar farm labor rules) and how serious the violation was. The person can ask for a government hearing within 30 days after getting the fine notice. If they do not ask, the fine becomes final and cannot be appealed. If there is a hearing, an administrative law judge makes an initial decision, and the Secretary has 30 days to change it. After that, the person can go to a U.S. district court within 30 days and must send a copy to the Secretary; the court can overturn findings only if they lack substantial evidence. If the fine is final and unpaid, the Secretary sends the case to the Attorney General, who will sue to collect the money. All collected fines go to the U.S. Treasury.
