Title 29 › CHAPTER 32 — WORKFORCE INNOVATION AND OPPORTUNITY › SUBCHAPTER I — WORKFORCE DEVELOPMENT ACTIVITIES › Part B — Workforce Investment Activities and Providers › subpart 1 — workforce investment activities and providers › § 3152
The Governor must set rules, after talking with the State board, about who can get funds under section 3173(b) to run training programs in local areas. Eligible providers include three kinds: colleges that give recognized postsecondary credentials; programs registered under the National Apprenticeship Act; and other public or private training programs (this can include joint labor-management groups and adult education programs when combined with job skills training). Colleges and other providers must meet the Governor’s rules to be put on the official list of eligible providers. Registered apprenticeship programs stay on the list while their registration stays active. The Governor’s rules must look at provider performance (including the measures in section 3141), access across the State (including rural areas and technology), links to in-demand industries, licensing, use of industry certificates, program quality, costs, completion rates, and the ability to serve people with barriers or people who are working. Local boards can add stricter rules. New providers can get one year of initial eligibility if they give verifiable program data showing good outcomes, business partnerships, quality, and alignment with in-demand jobs. The rules must explain how to apply, how appeals work, and require review and renewal every two years. The State must make a public list with credential and performance information available through one-stop centers while protecting student privacy and allowing public comment. Intentionally false information or major violations can trigger at least a 2-year loss of eligibility and repayment of funds. States may agree to accept each other’s training accounts. These rules had to be in place within 12 months after July 22, 2014, with a transition option until December 31, 2015.
