Surety companies that issue bonds under this law or the Employee Retirement Income Security Act of 1974 must file a yearly report with the Secretary for every fiscal year they had those bonds. The report must use the form and detail the Secretary requires and be filed by the company’s president and treasurer or similar officers. The report must describe bond activity, such as premiums collected, claims paid, recoveries, and legal and administrative costs, plus any other related data the Secretary needs. If some specific information can’t be reasonably found or would not be useful, the Secretary may change or waive that requirement.
