Title 30 › CHAPTER 25 — SURFACE MINING CONTROL AND RECLAMATION › SUBCHAPTER V — CONTROL OF THE ENVIRONMENTAL IMPACTS OF SURFACE COAL MINING › § 1269
A permit holder can ask the regulator to release all or part of a performance bond or deposit. After the request is filed, the operator must run an ad in a local paper at least once a week for four weeks and send letters to nearby landowners and local agencies. The ad and letters must say where the land is, how many acres, the permit and approval date, the bond amount and the part to be released, and what reclamation work was done and the results. The regulator must inspect the site within 30 days of the request and decide in writing within 60 days if there is no hearing, or within 30 days after a hearing ends. The regulator can release money in stages if reclamation meets the approved plan: 60% after backfilling, regrading, and drainage control; more after revegetation, while keeping enough to pay for reestablishing plants for the operator responsibility period in section 1265; and the rest only after all reclamation is finished and the operator responsibility period in section 1265 has passed. No release is allowed if lands are still sending too much sediment into streams (see section 1265(b)(10)) or if soil productivity for prime farmland has not been restored (see section 1257(b)(16)). If release is denied, the regulator must give reasons and suggest fixes and allow a public hearing. The town must be told by certified mail at least 30 days before any release. People with a legal interest or relevant agencies may object in writing within 30 days after the last notice; if they ask for a hearing, the regulator must hold one in the area (or at the state capital if the objector chooses) within 30 days, advertise it for two weeks, and keep a verbatim record. The regulator may run informal conferences and has powers to take testimony, order witnesses or documents, inspect the land, and issue transcripts.
