The Secretary of the Army can give money to a State to help its Army National Guard carry out duties the Secretary assigns, if the Chief of the National Guard Bureau agrees. The Secretary decides how much money is appropriate. Money can be used only for duties that fall under the Secretary’s responsibilities listed in 10 U.S.C. 7013(b)(6), (10), or (11). The Guard must have been picked by a competitive process open to qualified public and private bidders, unless 10 U.S.C. 3204(a) allows an exception. That competition rule does not apply if the activity was done for the Federal Government by Federal or State employees on October 17, 1998. Payments must go through the Chief of the National Guard Bureau, and Army funds for a fiscal year may be used for Guard activities in that same year.
