Title 32 › Chapter 3— PERSONNEL › § 303
Allows the Army Secretary to let someone who can join the active Army National Guard enlist instead in the inactive Army National Guard for a single term of one or three years. The Air Force Secretary can do the same for the Air National Guard. Those same Secretaries can set rules to move enlisted members from active to inactive Guard if they were not previously in the inactive Guard, and to move people from inactive back to active Guard. Says that in peacetime no enlisted member can be forced to serve longer than the term they signed up for. Also lets the Army and Air Force Secretaries set rules to transfer officers between active and inactive Guard to fill vacancies in federally recognized units, and to move those officers back when needed.
