States must not use money from their water pollution control loan funds to build, change, or repair treatment works unless every iron and steel product used is made in the United States. Iron and steel products here include pipes and fittings (lined or unlined), manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and related construction materials. The Administrator may waive this rule if it would hurt the public interest, if U.S. products are not available in enough quantity or quality, or if using U.S. products would raise project costs by more than 25 percent. If a waiver is requested, the Administrator must post the request and related information online (including on the official EPA website) and allow at least 15 days of informal public comment before deciding. The rule must follow U.S. international agreements. The Administrator may keep up to 0.25 percent of the funds for oversight. Projects with state-approved engineering plans dated before June 10, 2014 are not covered.
