The Secretary may improve or increase output from hydroelectric plants at Army water projects when money is available. Before doing so, the Secretary must talk with other Federal and State agency leaders and find that the changes are economically justified and financially feasible, will not significantly harm the project’s other purposes or the environment, will not require major structural or operational changes, and will not hurt existing Federal, State, or tribal water rights. The Secretary must give affected State, tribal, and Federal agencies the proposed findings and either accept their comments or reply in writing to objections. The Secretary may accept and spend funds from preference power customers under Federal power‑marketing law. This does not apply to facilities funded under section 839d–1 of title 16 and does not change the authorities in that section.
