The Secretary of Transportation must enforce these rules and can let other federal officers or employees do the enforcement. The Secretary must regularly check vessels that carry municipal or commercial waste to make sure each one has the required permit. The Secretary of the Treasury may refuse the official clearance a vessel needs if it does not have that permit. If a vessel breaks the rules, the Secretary of Transportation can refuse it entry to any place in the United States and can hold it at the U.S. port it is about to leave. The Administrator must investigate an owner or operator when the owner has 5 or more separate violations during a 6-month period.
