Anyone who pays a claimant under this law — including the Fund — can take over the claimant’s legal claims against other people or parties who are responsible. If the payer only makes a partial or temporary payment, they can only use the claimant’s rights for the part they paid. Getting a partial payment does not stop the claimant from later seeking the full amount they deserve. If the Secretary asks, the Attorney General must sue to get back money the Fund paid and related costs, like interest, fees, and administrative expenses. Suits can be brought against responsible parties, guarantors (subject to section 2716), or anyone else who is liable, including a responsible foreign government for oil discharges from facilities seaward of the exclusive economic zone. Department or agency heads may settle claims not sent to the Attorney General, but any settlement that may recover more than $500,000 (excluding interest) needs the Attorney General’s prior written approval.
