Owners and operators must show they can pay for oil-spill cleanup and damage costs for certain ships and offshore facilities. That includes vessels over 300 gross tons (except non-self-propelled ones that do not carry oil), tank vessels over 100 gross tons, vessels that transship oil in the U.S. exclusive economic zone, and offshore facilities that could spill more than 1,000 barrels. For offshore facilities, the required proof is $35,000,000 if the facility is seaward of a State’s seaward boundary, or $10,000,000 if landward of that boundary. The President can require up to $150,000,000 for higher-risk operations. If one party is responsible for several facilities, they only need to show the amount required for the single facility with the highest requirement. Deepwater ports must show enough to cover their maximum legal liability. Proof of financial responsibility can be insurance, a surety bond, a guarantee, a letter of credit, self-insurance, or other approved methods; bonds must come from companies allowed to do business in the United States. The Secretary of the Treasury can withhold or revoke clearance, deny entry, detain, or cause seizure and forfeiture of vessels that lack the required proof. A guarantor can be sued directly for covered claims, but may use the same defenses available to the responsible party; direct claims against guarantors for offshore facilities are allowed only if the responsible party is insolvent, has filed bankruptcy, or the United States asserts the claim. The President must set up rules to implement those limits within one year after October 19, 1996. A guarantor’s total liability cannot exceed the amount they provided. Existing financial-responsibility rules stay in force until replaced, and a single unified certificate may be issued to cover this law and others.
