Title 33 › Chapter 43— NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION COMMISSIONED OFFICER CORPS › Subchapter III— SEPARATION AND RETIREMENT OF OFFICERS › § 3042
An officer who is separated for the covered reason and who has more than three years of continuous active service right before separation may get separation pay unless the Secretary decides the separation circumstances do not deserve pay. If the officer has six or more years of service, the pay is 10% of (years of service × 12 × the monthly basic pay the officer had at separation). If the officer has three or more but less than six years, the pay is half of that amount. Other existing rules that apply to separation pay for officers also apply to this pay in the same way. An officer who is discharged after twice failing promotion is not eligible if they asked not to be considered for promotion or asked to be removed from the selectees list.
