Title 33 › CHAPTER 43 — NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION COMMISSIONED OFFICER CORPS › SUBCHAPTER V — RIGHTS AND BENEFITS › § 3079
The Secretary can pay for a person’s school costs so the Administration keeps enough commissioned officers. The help is for people who are studying full time at an accredited school (as decided by the Secretary of Education) in a program that will give them a bachelor’s degree in no more than five years or a post‑bachelor degree. To get help, a person must be full‑time, meet all officer entry rules except the degree, and sign a written agreement to accept an officer appointment if offered and to serve on active duty after finishing school. If the person got less than three years of help, they must serve up to three years. If they got three or more years of help, they must serve up to five years. Help can last no more than five straight academic years. The aid can cover tuition, fees, books, lab costs for bachelor programs, and other items the Secretary approves. The yearly amount cannot be more than the figure in 10 U.S.C. 2173(e)(2). Students also get a monthly living allowance equal to the rate in 10 U.S.C. 2144(a). The Secretary can give an initial clothing issue payment and a normal new‑officer clothing payment when appointed. Help ends if the person is released from the agreement, breaks its terms, or is removed for misconduct. The Secretary can require repayment that matches the share of unserved duty, can waive the duty for certain uncontrollable or medical disqualifications, and can make rules to run the program. A bankruptcy discharge entered less than five years after the agreement ends does not cancel this repayment duty. Service required here can count at the same time as service required under section 3006.
