Title 33 › Chapter 52— WATER INFRASTRUCTURE FINANCE AND INNOVATION › § 3912
The law lets federal money be provided for carrying out this chapter. It names exact yearly amounts that can be used and says the money can remain available until spent: $20,000,000 for fiscal year 2015; $25,000,000 for 2016; $35,000,000 for 2017; $45,000,000 for 2018; and $50,000,000 for 2019. The Administrator may get $50,000,000 for each of fiscal years 2020 and 2021. The Administrator may also get $50,000,000 for each of fiscal years 2022 through 2026. Part of the funds can pay for running the program and for technical help. Up to $2,200,000 may be used each year for fiscal years 2015–2019 for administration, and up to $5,000,000 each year for fiscal years 2022–2026. At least 15 percent each year must be set aside for small community water projects, but any set-aside money still unused by June 1 can be used for other projects. Up to 25 percent of yearly funds may be used for loans that are larger than 49 percent of a project’s total cost. For fiscal years 2022–2026, if the Administrator has at least $50,000,000 available in a year, an extra $5,000,000 may be provided to State infrastructure financing authorities for projects described in section 3905(9). No money under that extra $5,000,000 is allowed in a year if both of these are true for that year: the State loan funds under 42 U.S.C. 300j–12 are funded at less than either the FY2018 level or 105 percent of the prior year (whichever is greater), and the water pollution control revolving funds under Title VI are funded at less than either the FY2018 level or 105 percent of the prior year (whichever is greater). If such assistance is given to a State financing authority, the Administrator must say in the agreement how much of the aid comes from those funds.
