The Secretary of the Army, through the Chief of Engineers, must run a nationwide dam inspection program to help protect people and property. Almost all U.S. dams must be inspected. Exceptions are dams run by the Bureau of Reclamation, the Tennessee Valley Authority, or the International Boundary and Water Commission; dams built under licenses from the Federal Power Act; dams that a State agency inspected within the twelve-month period immediately prior to August 8, 1972 and that the State Governor asks to skip; and dams the Secretary finds pose no risk to life or property. The Secretary may still inspect Federal Power Act licensed dams if the Federal Energy Regulatory Commission asks, and may inspect International Boundary and Water Commission dams if that Commission asks. If a State dam safety agency asks, for any dam whose failure would affect that State, a Federal agency head must either give the State information about the dam’s design, operation, maintenance, condition, or emergency plans, or let a State official take part in the Federal inspection.
