Title 33 › Chapter 11— BRIDGES OVER NAVIGABLE WATERS › Subchapter I— GENERAL PROVISIONS › § 495
You must follow orders about bridges and related works from the Coast Guard Secretary or the Chief of Engineers. If you willfully refuse, you can be charged with a misdemeanor and fined up to $5,000 for each month you stay in default. The officials can also remove the bridge or work and make the owner pay the cost, and the United States can sue to recover those costs. Courts can order removal or other actions to stop or fix illegal structures, and cases about obstructions can be heard in any federal district court that the bridge or obstruction touches. Breaking these rules can also bring a civil penalty up to $25,000 for violations in 2008 and later, with each day treated as a separate violation. You must get notice and a hearing before a civil penalty is imposed. The Coast Guard Secretary can assess, collect, or reduce penalties until the case goes to the Attorney General, and unpaid penalties may be collected in federal court where the violation happened.
