Title 33 › Chapter 15— FLOOD CONTROL › § 701d
Congress lets two or more States make agreements to plan or run flood-control projects on rivers and streams that cross their borders. The States decide how to split costs and work, but the Secretary of the Army must approve the plan. The agreements can pay for construction, upkeep, damages, and buying land or rights. Most need Congress to approve them before they take effect, except when the Department of the Army will do and pay for all work (except small sums the States keep for taxes and State offices).
