Title 33 › CHAPTER 15 — FLOOD CONTROL › § 702a–12
Changes are made to the flood-control plan for the Mississippi River valley based on the Mississippi River Commission report of March 7, 1941. Levees in the Yazoo Basin on the east bank of the Mississippi River south of the Coahoma‑Bolivar County line must have a three‑foot freeboard above the project flood, and all levees must be built stronger and higher where needed. The Boeuf and Eudora Floodways, the Northward Extension, and their related back-protection levee are dropped from the project, but the Ouachita River levees in Louisiana stay part of the Mississippi River and Tributaries Project and will be operated and maintained under existing rules. The Yazoo River flood-control project stays authorized as before, but the Chief of Engineers may substitute reservoirs, levees, or channel work instead. Plan C from the March 7, 1941 report is allowed, including extending a levee along the east side of the Mississippi to meet the Yazoo levee near Yazoo City, at an added estimated cost of $11,982,000. The Chief of Engineers will set levee heights so they give the most protection without risking the Mississippi River main levees. Local authorities must promise to maintain the levees and not raise backwater levees above the limits set by the Chief before construction starts. A levee and other work to protect the Tensas‑Cocodrie Red River backwater area are approved as in the March 7, 1941 report at an estimated cost of $6,976,000, with similar rules on grades, local maintenance, and limits. The Chief may change or add works to protect more area up to $29,000,000 total, as long as main Mississippi levees and planned Atchafalaya diversions are not endangered. The Chief, with the Secretary of the Army, will reimburse local governments for reasonable costs of rights-of-way and flowage easements for future levee setbacks. The Saint Francis River plan is changed to allow building a ditch and a highway bridge in Cross County, Arkansas, if local interests give lands, protect the United States from damages, and agree to maintain the works. Improvements for Bayou Rapides, Boeuf, and Cocodrie from a March 24, 1941 report are authorized at an estimated $2,600,000. Overall project authorizations are not increased except for the Yazoo and Red River backwater items, and appropriations already made or later made may be used on any project feature; maintenance spending will not reduce remaining authorization balances.
