Title 33 › Chapter 18— LONGSHORE AND HARBOR WORKERS’ COMPENSATION › § 948a
Employers must not fire or punish a worker for asking for or claiming compensation from the employer, or for testifying or planning to testify in a case under this law. If a court finds the worker filed a fraudulent claim, firing or refusing to hire them is allowed. If an employer breaks this rule, the deputy commissioner can fine them $1,000 to $5,000. Fines go to the deputy commissioner for the special fund in section 944. Unpaid fines can be collected in a United States district court. The worker must get their job back and be paid lost wages unless they are no longer able to do the work. The employer, not the insurer, must pay these fines and payments; any insurance that tries to cover them is void.
