Stops federal officials from ordering or running state or local police or other criminal justice agencies. The National Institute of Justice, the Bureau of Justice Statistics, and the Law Enforcement Assistance Administration cannot force grant recipients to use racial quotas or ratios, and they cannot cut off grants because a recipient refuses to adopt those kinds of programs. Programs paid for with these funds must not exclude, deny benefits to, or discriminate in hiring against anyone because of race, color, religion, national origin, or sex. If a court, an agency, or the Office of Justice Programs finds a pattern or practice of discrimination, the Office will notify the state or local chief executive and try to get them to fix the problem. Any agreement to fix the problem must be written and signed, and the government must file reports on progress. If the problem is not fixed within 90 days and an administrative judge has not said the government is likely to win, the Office will tell the Attorney General and may suspend payments for the specific program for up to 120 days (or up to 30 days after a hearing). Payments restart only if there is an approved compliance agreement, a court or agency order that settles the issues, or a hearing finds no proven noncompliance. If the Attorney General sues for discrimination and no emergency relief is granted within 45 days, the Office must suspend funds to the program named in the suit until the court allows payment to resume. States and localities can request fast hearings to challenge suspensions. Individuals who are harmed can sue in court after administrative remedies are exhausted (60 days after filing unless the agency rules sooner). A winning private plaintiff may recover attorney fees unless the suit is frivolous. The Attorney General may also join private suits and seek the same relief as if the United States had started the case.
