To apply for a grant, the chief executive of a State, local government, or Indian tribe must send an application to the Director of the Bureau of Justice Assistance in the form and with the information the Director reasonably requires. The Director had to create rules about what to include and what applicants must meet not later than 90 days after June 16, 1998. A local government that got money from the Local Law Enforcement Block Grant program (from the 1998 Appropriations Act, Public Law 105–119) in the same fiscal year cannot get this grant unless its chief executive certifies to the Director and explains that the government considered using the block grant for some or all body armor costs but did not, or does not expect to, use those funds. If an application is tied to buying armor vests, the grant cannot pay for that purchase unless, before applying, the applicant was given clear notice that the grant is uncertain and expressly agreed to go ahead with the purchase even if the grant is not received.
