Title 34 › Subtitle II — Protection of Children and Other Persons › CHAPTER 215 — ADVANCED NOTIFICATION OF TRAVELING SEX OFFENDERS › § 21503
Create the Angel Watch Center inside ICE’s Child Exploitation Investigations Unit within 90 days after February 8, 2016. The Center must check people who plan to travel abroad to see if they are sex offenders by using all relevant databases. It must do those checks no later than 48 hours before a planned departure, review U.S. Marshals travel-notice lists, and give lists to the U.S. Marshals Service so they can check compliance with the Adam Walsh Child Protection and Safety Act of 2006. The Marshals must give the Center any matching travel information 24 hours before the travel, or no later than 72 hours after the intended travel. The Center may tell the destination country about a sex offender when appropriate, and may send immediate notices in cases involving travel within 24 hours. If a notification was wrong, the Center must immediately send a correction, fix its data, and, if needed, notify the Secretary of State for passport actions. DHS and the Attorney General must sign a Memorandum of Agreement within 6 months after February 8, 2016, to support these activities. The Center must also keep records of all notifications and responses, set up a complaint process to fix mistakes and notify affected people in writing, publish how to complain, report annually to Congress on errors and fixes, run an annual coordination review with the Attorney General, Secretary of State, and INTERPOL, and share travel information with the U.S. Marshals Service in a timely way. Definitions (one line each): covered sex offender — a person who meets the law’s covered-offender rules; sex offender required to register — a person who must be on a sex offender registry or is on the National Sex Offender Registry for an offense against a minor.
