Title 34 › Subtitle II — Protection of Children and Other Persons › CHAPTER 215 — ADVANCED NOTIFICATION OF TRAVELING SEX OFFENDERS › § 21504
The U.S. Marshals Service’s National Sex Offender Targeting Center can send notice to a destination country (and that country’s visa agents in the U.S.) when a registered sex offender plans to travel there. It can share travel information with federal, state, local, and foreign agencies. It must accept incoming notices about people with sexual offense histories who want to enter the United States and immediately tell the Department of Homeland Security. It must, when possible, try to notify destination countries ahead of travel about offenders found in local registries or the National Sex Offender Registry. It must give the Angel Watch Center access to its case system, tell that Center whether listed individuals meet the rules of title I of the Adam Walsh Child Protection and Safety Act of 2006 (42 U.S.C. 16901 et seq.), share travel information quickly, and work with the State Department on how the international notice program runs. If a notice is wrong, the Targeting Center must immediately send a correction to the destination country, fix its data, and notify the Angel Watch Center if needed. Notices may be sent by INTERPOL, FBI legal attaches, or other ways the Center chooses. The Attorney General must collect records of each notice, destination-country responses, any choice not to send a notice, the number and countries of transmissions, whether the notice went out before travel, and other needed details. The Center must have a way for people harmed by wrong notices to complain, review complaints quickly, forward complaints about other federal agencies, and tell people in writing if they were wrongly reported and what was done to stop it happening again. The Attorney General must report each year to Congress on mistaken notifications and fixes. “Sex offender” here means someone covered by SORNA or required to register with any jurisdiction or included in the National Sex Offender Registry.
