The Attorney General must set up a way for a State to apply for a grant under this chapter. A State must send an application when and how the Attorney General requires and include the information the Attorney General asks for. The application must say the State allows and pursues capital punishment cases. It must describe the communities the grant will help and the current defender and prosecutor services there. It must include a long-term statewide plan made with courts, the bar, and State and local prosecutor and defender groups that focuses on better trial-level defense and prosecution in capital cases. If the State uses the procedure in section 60301(e)(1)(C), it must certify it is substantially complying with that law. The application must also promise that federal money will add to, not replace, nonfederal funds and will be distributed as required by section 60306(b).
