After the deadlines for filing the statement and reply have passed, the Patent Office will reexamine the patent using the same procedures it uses for an original examination. During reexamination, the patent owner may propose amendments or new claims to show how the invention is different from the cited prior art or to answer a decision that a claim is unpatentable, but no amendment or new claim that broadens a patent claim is allowed. All reexamination work, including any appeal to the Patent Trial and Appeal Board, must be handled quickly by the Office.
