When fighting creates military cemeteries outside the United States, the American Battle Monuments Commission and the Secretary of the Army must, as soon as fighting stops, pick which sites will become permanent or choose different locations. The Commission alone must design and build the permanent cemeteries and all permanent features. The military must care for them until the Commission says it is ready to take over. Any military construction done before transfer must be temporary. Burials must follow Commission plans, and the military may return to remove or re‑bury remains if needed.
