§40728A Recovery of Excess Firearms, Ammunition, and Parts Granted to Foreign Countries and Transfer to Corporation

Summary

The Secretary of the Army may take back surplus firearms, ammunition, repair parts, or other supplies that were given as grants to a foreign country under section 505 of the Foreign Assistance Act of 1961 (22 U.S.C. 2314) if those items are more than the country needs. The cost to recover those items is treated as extra direct costs for providing logistical support to the corporation and must be reimbursed as set in section 40727(a). The Secretary can require the corporation to pay those costs in advance. Advance payments are not subject to section 3302 of title 31 and are handled under the last sentence of section 40727(a). Recovered items may then be transferred to the corporation under section 40728 and any additional rules the Secretary sets.
