Title 38 › PART II — GENERAL BENEFITS › CHAPTER 11 — COMPENSATION FOR SERVICE-CONNECTED DISABILITY OR DEATH › SUBCHAPTER II — WARTIME DISABILITY COMPENSATION › § 1113
If there is clear evidence that a condition was not caused by service, or that a new injury or illness known to cause the condition happened after the veteran left the service but before the condition started, or if the disability was caused by the veteran’s own on‑purpose misconduct, then benefits under sections 1112, 1116, 1117, 1118, or 1120 and payments under section 1117 will not be allowed. Nothing in those sections, in the paragraph above, or in section 5 of Public Law 98–542 (38 U.S.C. 1154 note) stops the VA from granting service connection when good judgment shows a disease or disorder was caused or made worse by active military, naval, air, or space service.
