The VA Secretary must not give hospital, nursing home, or other medical care outside any U.S. state, except in a few specific cases the law allows. The Secretary may give care abroad when it is needed to treat a service-connected disability or as part of a Chapter 31 rehabilitation program. For non‑U.S. citizens, that care is allowed only in the Philippines or Canada unless the Secretary decides otherwise under rules. At the Veterans Memorial Medical Center in Manila, the VA can pay for needed hospital care for non‑service‑connected problems if a veteran can’t afford it, and the VA may make contracts to do this. The Secretary can also provide long-term nursing home care to veterans who got hospital care in the Philippines under these rules, following the same terms as section 1720(a). In a VA outpatient clinic in the Philippines, the VA may give needed medical services for service-connected disabilities. The Secretary may also provide care in the Freely Associated States under agreements required by the Compact of Free Association Amendments Act of 2024, section 209(a)(4)(A). Those agreements must, where practical, follow local laws and say what care can be provided. Care there can be by contract, reimbursement, or VA staff, and may be for any condition. Veterans who already got care in a country under this rule can remain eligible there as the Secretary finds appropriate; if eligibility ends, the VA must notify those veterans and publish the reason in the Federal Register. The Freely Associated States named are the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau while each is party to its Compact.
