The Secretary can inspect any State home whenever needed. The government will not pay or give grants to a home under this law unless the Secretary says the home meets the standards the Secretary sets; for nursing home care, those rules must be at least as strict as the ones in section 1720(b). The Secretary can count how many people in a State home qualify for payments under this law, but cannot manage or control the home.
