Title 38 › PART II — GENERAL BENEFITS › CHAPTER 17 — HOSPITAL, NURSING HOME, DOMICILIARY, AND MEDICAL CARE › SUBCHAPTER VIII — HEALTH CARE OF PERSONS OTHER THAN VETERANS › § 1785
The Secretary of Veterans Affairs can provide hospital care and medical services during and right after certain disasters or emergencies to people who are responding to, involved in, or affected by them. The rule covers two kinds of events: a major disaster or emergency declared by the President under the Robert T. Stafford Act, and an event when the National Disaster Medical System (set up under section 2812 of the Public Health Service Act) is activated by the Secretary of Health and Human Services. Veterans can get this care even if they are not enrolled under section 1705. Other federal departments or the military must pay the VA for care their staff or members receive, at rates the VA and the agency agree on and based on the cost of care. Money collected goes to the Medical Care Collections Fund under section 1729A. Within 60 days after a covered disaster starts, the Secretary must report to the Senate and House Committees on Veterans’ Affairs about how facilities and staff were used. The Secretary must also make rules to carry out this authority.
