Title 38 › Part II— GENERAL BENEFITS › Chapter 17— HOSPITAL, NURSING HOME, DOMICILIARY, AND MEDICAL CARE › Subchapter VIII— HEALTH CARE OF PERSONS OTHER THAN VETERANS › § 1786
The VA can pay for a newborn’s medical care and necessary travel for up to seven days after birth when the baby’s mother is a woman veteran getting VA maternity care. Coverage applies if the baby was born in a VA facility, in a facility working under a VA contract, or if the mother gave birth before reaching one of those places. Care includes all routine post-birth treatments a newborn needs, and can include care at another hospital (for example, a pediatric specialty hospital) if the baby is transferred. The VA can extend care and travel beyond seven days if a medical professional says the baby still needs treatment, including readmission after discharge. Travel can cover the child and parents and may include ambulance or air ambulance for transfers or emergencies. Payments come from the VA’s Medical Services account. The VA will pay providers directly unless a contract already covers the cost; contract terms then apply. If the VA pays a provider for a family’s care, that payment cancels the family’s bill unless the provider returns the money within 30 days. A “covered entity” means anyone or any organization that provided or paid for the care or travel.
