Title 38 › Part III— READJUSTMENT AND RELATED BENEFITS › Chapter 32— POST-VIETNAM ERA VETERANS’ EDUCATIONAL ASSISTANCE › Subchapter I— PURPOSE; DEFINITIONS › § 3202
Defines key words used in the chapter. Eligible veteran means a veteran who is not getting education help under chapter 34 and who either (A) entered service on or after January 1, 1977 and before July 1, 1985, served more than 180 days of active duty starting on or after January 1, 1977, and left the service under conditions other than dishonorable, or (B) entered in that same period and was discharged after January 1, 1977 for a service-connected disability. The need to be discharged can be waived if the person finished their first required active-duty period (which began after December 31, 1976) or six years of active duty (which began after December 31, 1976), whichever is shorter. Time spent as a full‑time student assigned to a civilian school, as a service academy cadet or midshipman, or certain Guard/Reserve service under section 511(d) of title 10 does not count as active duty. A veteran who earned chapter 34 eligibility only because of pre‑1977 Guard/Reserve service may choose to get benefits under this chapter instead of chapter 34, but that choice is final. Program of education means the term in section 3452(b) and also includes approved full‑time apprenticeships or on‑the‑job training and, for those not on active duty, approved cooperative programs. Participant means a person taking part in this chapter’s education program. Educational institution and training establishment mean what sections 3452(c) and 3452(e) say.
