The Secretary must send Congress a yearly report by July 1 about the previous fiscal year after consulting the Attorney General and the Special Counsel named in section 4324(a)(1). The report must list how many cases each office reviewed (the Secretary, the Secretary of Defense through the Employer Support of the Guard and Reserve, referrals to the Attorney General and the Special Counsel, and complaints the Attorney General filed). It must also show how many cases involved the same person, how many involved disability or a service-connected disability, what each case was about and its status, how many involved different jobs (using the Standard Occupational Classification), whether there are any clear patterns of violations and why, and any recommendations for administrative or legal changes, including ways to encourage mediation before a claim is filed. Within 30 days after each fiscal quarter ends, the Secretary must give Congress, the Secretary of Defense, the Attorney General, and the Special Counsel a quarterly report showing how many cases missed the timing rules in section 4322(f) and how many requested referrals under section 4323(a)(1) were not made on time. Within the same 30 days, the Attorney General must report how many referrals received under section 4323(a)(1) were not handled as required by section 4323(a)(2), and the Special Counsel must report how many referrals received under section 4324(a)(1) were not handled as required by section 4324(a)(2)(B). The Secretary must also work with the Secretary of Defense, the Attorney General, and the Special Counsel so the reports use the same categories and so they each have electronic access to the case files, while following the privacy rules in 5 U.S.C. 552a.
