VA can split a veteran’s compensation, pension, or emergency officers’ retirement pay so part goes to the veteran’s spouse, children, or dependent parents when the veteran is getting hospital, institutional, or domiciliary care from the United States or a local government. If the veteran does not live with the spouse or some children are not in the veteran’s custody, the VA Secretary may decide how to divide the payments. The Secretary may also divide survivor payments (including dependency and indemnity compensation) and subsistence or education allowances under chapter 31 or chapter 34 in similar situations.
