The Secretary can ask a bank or other financial institution for someone's records under the Right to Financial Privacy Act of 1978 only if the records are needed to run the relevant benefit laws and cannot be found by a reasonable search of Department files. Each request must include a written certification of that decision, and the information may be used only to administer the Secretary’s benefit programs when the privacy law would otherwise bar its disclosure.
