The Secretary must create an Advisory Committee on Tribal and Indian Affairs to give advice about Indian tribes, tribal organizations, and Native American veterans. The Committee will have 15 voting members picked from nominated people. At least one member must come from each of the 12 Indian Health Service areas, one must represent Native Hawaiian veterans nominated by a Native Hawaiian organization, one must represent urban Indian organizations nominated by a national urban Indian group, and at least half the members must be veterans unless not enough veterans were nominated. No federal employees can serve. Members serve two-year terms and any vacancy must be filled within 180 days. The Committee must meet in person at least twice a year, hold monthly calls if needed, and may meet virtually during a public health emergency as defined in the CARES Act. Federal agency representatives may attend meetings but cannot vote or get extra pay. The Committee can make subcommittees, including non-members if the Secretary agrees, but subcommittees cannot replace the main Committee or give direct advice to the Department. The Committee’s duties include advising on how the Department can better serve Native American veterans, spotting important issues, proposing solutions, offering a forum for tribes and organizations to discuss Department policies, advising on consultation priorities and procedures, encouraging coordination with other agencies and Congress so veterans get full benefits, highlighting Native American veterans’ service, and making recommendations on consultation and urban Indian confer policies. The Committee must send recommendations to the Secretary and the appropriate congressional committees at least once a year. The Secretary must reply in writing within 90 days of receiving a recommendation and must post the recommendations, the replies, and the Committee’s biennial reports on the Department’s website. Members may be paid travel expenses and per diem at the same rates as federal employees under the law. Section 14 of the Federal Advisory Committee Act does not apply to this Committee.
